Therefore, another consideration when choosing a location is the aesthetic appeal.
Consider the Purpose
There are many factors to consider when choosing a spot for your garden that looks good. First, you need to determine the overall purpose of your garden. If you are planting flowers to landscape the home and to give it a trimmed and well-kept look, you might actually have several small garden areas in your yard. For example, you might put trim around the bottom of large trees and plant flowers there.
You might also plant flowers around the outside perimeter of your home or along your driveway in order to create a neat and tidy appearance.
Use What You Already Have

IÂ have planted several gardens in my yard. Each has its own unique character and the locations I chose were for different reasons. For example, the first garden I planted was in a shade garden. On the other side, some wild bushes and trees had been allowed to grow.
We decided to place a small shed in the back end of this cove because the trees provided excellent wind protection. Then, I lined either side of the cove and planted shade loving flowers. The result is a beautiful mixture of wild flowers and bushes growing behind my well-trimmed display of flowers. I took an area that was already a part of my land and turned it into my own secret garden.

Common Law Breakups – (Part 3) Examples of how property can be divided…

So this is the third article in a series I’m writing about how property and other issues are dealt with on the breakdown of a common law relationship. In my first article, I mentioned how common law relationships end differently from married ones because the Family Law Act does not give a non-married spouse rights to the other spouse’s property. Then I mentioned how non-married spouses use EQUITABLE doctrines such as UNJUST ENRICHMENT, CONSTRUCTIVE and RESULTING TRUST to try to create interests, rights and entitlements to the other spouse’s property. I reviewed these equitable doctrines in my second article. In this article, I’ll review some examples of how courts have applied these doctrines to actual real life cases.
Peter v. Beblow: CONSTRUCTIVE TRUST + 100% interest in FAMILY HOME
In Peter v. Beblow, [1993] 1 S.C.R. 980, the Supreme Court of Canada considered whether a partner in a long-term common-law relationship could claim restitution for contributions made to the family home during the period of cohabitation. The Supreme Court found that the common law wife had maintained the family home through work in cooking, cleaning and landscaping â?? which helped preserve the property and saved the common law husband large sums of money which he used to pay off his mortgage and purchase a houseboat and a van. The trial judge found that the common law husband had been enriched, that the common law spouse had not been compensated, and that there was no juristic reason (e.g. gift, contract) for the enrichment. As such, the common law wife had a claim for UNJUST ENRICHMENT (see my previous blogs for more about this). Now, since it was difficult to provide the common law wife a monetary award, the doctrine of CONSTRUCTIVE TRUST came into light. This remedy was appropriate because the common law wife had established an UNJUST ENRICHMENT AND was also able to establish a link between the contribution that founds the action and the property in which the constructive trust is claimed. On these grounds, the Supreme Court did not disturb the trial judge’s findings, stating that the house reflected a fair approximation of the value of the common law wife’s efforts in acquiring the family assets.
Gauci v. Malone: CONSTRUCTIVE TRUST + 20% interest in FAMILY HOME
In Gauci v. Malone, [2009] O.J. No. 2627, the Ontario Superior Court of Justice was dealing with a situation similar to that in Peter v. Beblow (discussed above). The parties cohabited for 7 years before ending their relationship. One of the issues that arose was the common law wife claiming a CONSTRUCTIVE TRUST over the family home. The Court cited Peter v. Beblow and found that the common law wife had improved the backyard and garden areas of the home and was primarily responsible for childcare, meals, and housecare. Through her efforts, despite not being compensated, the common law husband and the property had been enriched. There was no juristic reason for the enrichment. As such, the court found that the common law spouse had made out an UNJUST ENRICHMENT claim. Now, given that the common law husband did not have discretionary funds available to pay, the Court concluded that a monetary award was not appropriate and therefore gave her a 20% ownership interest in the family law pursuant to the doctrine of CONSTRUCTIVE TRUST. That amount would not be realized or paid to her until the home was sold or until her two children were no longer dependents.
Rendell v. Normore: UNJUST ENRICHMENT + K
In Rendell v. Normore, [2008] O.J. No. 3287, the Ontario Superior Court of Justice dealt with the issue of whether a women could assert claims against her former partner based on RESULTING or CONSTRUCTIVE TRUST or UNJUST ENRICHMENT. The parties had been together for 4 years. During that time, the man purchased a family home in his name and made all mortgage and other payments (e.g. utilities, taxes, etc.) related to the home.  The woman claimed an interest in the house and property purchased by the man during the time they lived together. The Court first looked at whether the woman could claim a RESULTING TRUST. Recall that, for a RESULTING TRUST to be established, there must be a common intention expressed or implied between the parties such that the woman would have had an interest in the property. The Court could find no evidence of such an intention. The parties conducted themselves in a manner that demonstrated that they had no intention of giving the woman any interest in the property. It was purchased and maintained solely by the husband, and purposely structured this way by the parties. SO NOT RESULTING TRUST CLAIM was found. What about CONSTRUCTIVE TRUST? Well, in this regard, the Court found that the woman had made some financial contribution to the relationship and property from her work and services (e.g. paying for household bills, food, gas, renovations, etc.). But the Court concluded that CONSTRUCTIVE TRUST was not an appropriate remedy since the man had made a more significant contribution to the relationship and the property. Thus, in the grand scheme of things, the Court ordered the man to simply compensate the woman ,000 because he had been unjustly enriched by the woman’s work and services.
Robichaud v. Anderson: CONSTRUCTIVE TRUST +K
In Robichaud v. Anderson, [1989] O.J. No. 3031, the Ontario District Court deal with a situation involving a common law husband seeking an interest in the family home which the common law wife owned. That husband also sought half the proceeds of an investment home which the parties had acquired together through an investment. The parties had been together for over 11 years. The court found NO common intention for the husband to have an interest in the home (so NO RESULTING TRUST); that said, the Court concluded that the husband had an interest in the home on the basis of CONSTRUCTIVE TRUST. The Court reasoned that the husband had shared living expenses, contributed time and labour to improving the property, and claimed that the common law wife had promised him a 1/2 interest in the property. The Court found that the husband had established an UNJUST ENRICHMENT CLAIM and that monetary damages in the amount of ,300 was appropriate. The Court ordered the family home to be sold to pay for this amount.  With respect to the investment property, the Court found no evidence supporting the husband’s claim for unequal division of the proceeds. The investment agreement provided for equal division, and this was ordered.

Australia, the world’s largest island, has some of the best surfing beaches to be found anywhere. Here, visiting the beach is as much a social experience as an opportunity for relaxation and water sports, since the beach is integral to Australian culture. While there will always be disagreement over which of the thousands of beaches are the best, the following selection represents a variety of urban and regional surf beaches that are popular with both surfers and those looking for a fun day on the beach.
Noosa Heads, in Queensland, is one of Australia’s best family beaches. Facing north, it is more like an ocean cul-de-sac, with generally gentler surf conditions than might be found on the more open beaches. Just behind the beach is the famous Hastings Street shopping strip. High fashion boutiques, art galleries, and trendy restaurants run along its shopper-friendly pavements, shaded by lush, leafy trees.
The Gold Coast’s Burleigh Heads is famous for its pine tree backdrop and great point break surf. The famous Burleigh Barrel, a power-packed tube loved by all surfers is driven by solid swells and prevailing SE winds. Burleigh’s shopping precinct just off the beach is a quiet and eclectic collection of shops and cafes.
Byron Bay, in northern New South Wales, is considered Australia’s alternative lifestyle capital. The trendy town centre, boasting top-quality eateries and pubs, is fronted by a superb beach. The lack of high-rise development adds to the clean, laid-back appeal of this pristine location. Close to the beach strip are subtropical rainforests and national parks that you can easily visit.
On Sydney’s northern coastline, Palm Beach is noted as a residential suburb for the wealthy as much as for its surf beach. Situated on a peninsula, the beach has stunning Pacific Ocean front expanses with a variety of swells, and there are gentler waters on the west of the peninsular at Pittwater. Surrounding bushland adds to the feeling of genteel serenity.
Australia’s most famous beach, Sydney’s Bondi Beach, is where Australian beach culture originated. This stunning beach, bounded by rocky points at either end, abuts a vast promenade with a distinctively old world charm. Its wide stretch of sand is dominated by the grand old Bondi Pavilion, built in 1928. Campbell Parade, running parallel to the beach, is a people watcher’s delight.
Two hours’ drive south of Sydney is Kiama, where the beautiful Surf Beach offers a deep beachfront of pure white sand, gentle incoming waves, and an open park with cooking facilities and picnic areas. The beach is popular with families, and many visitors come to view the breath-taking Kiama Blowhole nearby.
At Portsea, in Victoria, Melbourne’s wealthy come to retire for a summer respite. Set on the western-most point of the sweeping Mornington Peninsula, Portsea boasts a fascinating, rugged ocean front beach as well as a quieter bay beach nearby. Stark rock formations, shaped by the area’s often savage winds, feature prominently around the beach landscapes. The tiny village has a feel of understated exclusivity.
Many would claim Bells Beach as Australia’s best board surfing beach. Located 100 km south west of Melbourne along the majestic Great Ocean Road, Bells is a largely untouched ocean beach with almost never-ending swells undulating across deep blue water. The beach ends abruptly with soaring cliffs of yellow and orange clay. Designated a state reserve, its unspoiled status is assured.
Margaret River, in Australia’s south west, is virtually unrivalled for the quality of its waves. The clear, open water swells and forms some of the world’s best and most consistent board and body catches. Dazzling views across the mighty river and its mouth as it spills into the Indian Ocean are plentiful. Margaret River township is a mellow precinct dotted with great cafes and art galleries.
Perth’s Cottesloe Beach is understandably that city’s pride and joy. The now ritzy suburb, just outside Perth CBD, affords unbeatable views across the ocean to gorgeous Rottnest Island. The westerly-facing beach, part of a long strip, is a fantastic place to watch the sun set on another day. The stately old surf club and restaurant provides a regal focal point.

Overview
Bok Tower Gardens is situated on Florida’s highest peninsular point. It has a wonderful 205 foot tower with 57 bells that play to the public every day. The tower itself stands in a fabulous landscape of over 200 acres with magnificent woodland gardens which offer a good variety of tropical plants and gives visitors the opportunity to see some central Florida wildlife.
A good site map can be obtained at the gate and this helps you to find quiet relaxing area for those who are looking for quiet and solitude whilst at the same time enjoying the tower bells. The white garden is a popular backdrop for weddings, there is a grove of live oaks and a reflection pool that mirrors the tower itself. Just find a bench, sit quietly and admire the stunning views.
With 20 rooms, the property’s Pinewood Estate is considered to be one of the state’s finest examples of Mediterranean Revival architecture.
The tower and gardens have nonprofit status as an educational institution. They operate a program for fourth graders as well as an adult Garden Campus with 60 programs offered to the public. Included are day tours, classes, workshops and slide lectures.
There is also a café and gift shop to buy your souvenirs.
The address of Bok Tower Gardens is 1151 Tower Boulevard, North of Lake Wales, Florida 337853. It is also a National Historic Landmark that is listed on the National Register of Historic Places.
History
It was in 1869 that a young Edward William Bok (born 1863 – died 1930) arrived in Brooklyn, New York from Den Helder, in the Netherlands. At the tender age of 13 he left school to work as an office boy and free lance writer to earn money to help his struggling family. He wrote many reviews and also edited a church newspaper. By the time he had reached age 22, his own company called Bok Syndicate Press, was selling women’s features to newspapers.
In 1889, at age 25 he was hired as the editor of the very popular women’s magazine called The Ladies Home Journal. It was here that he enjoyed a brilliant career lasting 30 years. By the turn of the century his magazine was the most popular in the country and Mr. Bok had amassed a fortune.
He retired in 1919 and in 1922 he purchased a large tract of scrub and pine land on Iron Mountain, a 298 feet prominence located near Lake Wales. Advise in his youth by his mother to “Make the world a bit better or more beautiful because you have lived in it”, Mr. Bok now had both the time and the money to carry out his mothers wishes.
It was his desire to do nothing less than to create an American Taj Mahal. His book of that same name carries this dedication to the tower’s designer: “To Milton B. Medary, for his architectural conception of a Tower with no ancient, medieval or modern precedent and of surpassing beauty, nativeness and originality…”
Gardens
Frederick Law Olmsted, Junior designed the beautiful gardens at Bok Tower. It contains acres of ferns, palms, oaks, pines, and wetland plants. It should also be mentioned that Mr. Olmsted also designed New York Central Park. The plantings also include bunya-bunya trees, camellias, tree ferns, creeping fig, yaupon and dahoon holly, Asiatic jasmine, justica, crinum.and spider lily, wax myrtle, date and sabal plams, papyrus, philodendron, blue plumbage, and horsetail rush. The site is a haven for more than a hundred bird species, the most prominently featured of which is the group of swans, who tend to stay near the reflection pool.
Although the gardens provide an assortment of native wildlife including birds, reptiles, and butterflies, the gardens also are well known for a large population of squirrels that show no fear of humans and often can be hand fed.
Singing Tower
The Singing Tower is the centerpiece of the gardens, and was designed by Milton Medary. It was built at the highest elevation of the site, south of a reflection pool that allows the water to reflect its full image. A 60 bell carillon is set within the 205 foot tall Late Gothic Revival tower. Construction on the tower began in 1927 and was completed for the dedication of the gardens in 1929, when it was dedicated by President Calvin Coolidge. The tower is 51 feet square at its base, changing form at 150 feet high to an octagon with 37 feet sides that include sculptures designed by Lee Lawrie. The tower is surrounded by a 15 foot moat that serves as a Koi carp fish pond. It is built of pink Etowah marble and gray Creole marble, mined in Tate, Georgia, and Florida native coquina stone, from Daytona Beach, Florida.
Although the tower’s interior is not open to the public, it contains the Anton Brees Carillon Library, said to be the largest carillon library in the world.
Inside the bell chamber is a playing room that houses a clavier, or keyboard, that is used for playing the carillon bells. Recitals are given daily from the 60 bell carillon set.
Pine Ridge Trail
The Pine Ridge Nature Preserve and Trail is a Longleaf Pine turkey Oak habitat. Pine communities similar to this one used to cover millions of acres in the southeastern United States. However, over the years, these have gradually disappeared and are now in danger of totally disappearing. However, a small portion has been preserved in the Pine Ridge Nature preserve.
This habitat is an ecosystem typified by the overstory of Longleaf Pine and a dense groundcover of perennial grasses. Visitors can experience this natural habitat on a three quarter mile trail that begins at Window by the Pond and ends at the parking lot. There are many shaded benches along the route which serve as places for relaxation and time to think. Along the trail, you will see a bog garden, an open glade and a sand hill forest community that is one of the most endangered ecosystems in the world.
Pinewood Estate
Pinewood was built between 1930 and 1932 under the original name of “El Retiro”.
Taking a tour through the magnificent Mediterranean style Pinewood Estate lets you experience the luxurious lifestyle of C. Austin Buck, a 20th century industrialist who was vice president of Bethlehem Steel Co. in Pennsylvania. Pinewood was his winter home.
The estate covers around eight acres of Bok Tower Gardens and is enjoyed by thousands of visitors every year.
The mansion has 30 rooms and is listed on the National Register of Historic Places. It is considered to be one of the finest examples of Mediterranean style architecture in Florida. From time to time, special musical performances are features at Pinewood Estate.
Events
Throughout the year, there are numerous events designed to draw visitors to the Gardens. These events include various concerts featuring folk music, jazz, orchestras, and the carillon bells of the Tower. The most popular is the semi annual Concert Under the Stars, given in the evening once in the Fall and once in the Spring. The event draws hundreds of visitors to the large field in front of the Tower for an outdoor picnic; and features music from both the symphony orchestra and carillon bells.
Bok Sanctuary is open daily and an admission fee is charged. It comprises the gardens, the Singing Tower with its carillon bells, Pine Ridge Trail, Pinewood Estate, and a visitor center.

To garden in the desert sounds like a paradox. We all know the desert is hot and is known for its extremes. We also know that most deserts get less than ten inches of rainfall annually and that the soil is rocky or desperate for nutrients due to the high content of clay or caliche soil. But despite all these adverse conditions, gardening in the desert states of the Southwest is not impossible. Matter-of-fact, it is an art and though the rules are a little different, you too can take up what is called xeriscaping.
It used to be that before you landscaped your yard, you started off by removing all of the rocks and cactus. But if you are gardening in the desert xeriscape style then you are keeping those rocks and cactus and maybe adding a few more to your yard. This isn’t to say xeriscaping is about making your yard look exactly like the desert around you. It is much more. The desert is full of color and there are numerous plants that thrive in hot climates with very exotic beauty. The idea of xeriscaping is taking all of these beautiful desert flowers that grow around the world and bringing them to your backyard.
The xeriscaping concept is also based on planting plants that survive best in a desert climate. This would be the opposite of trying to make plants that thrive in rainy or cooler climates grow in the desert. In doing this, you not only have to water much more than usual, but it is most likely the plants will not survive the heat. A native desert plant can withstand heat and less water, as their roots are closer to the surface of the ground so they can capture desert rains. They are also less susceptible to disease.
Xeriscape plants not only use less water (half of water usage in the country is from landscaping), but the plants also require less pruning and fertilizer.
So where do you start if you want to xeriscape your yard? Drawing out a design that integrates your yard’s unique qualities along with integrating dimension is important. The right plants, rocks, rolling scapes and gravel can do just this. Watch for natural recesses that collect water in your yard, they can serve as a good location for plants that require a bit more water. Mix color up in your yard. Desert flowers and cactus come in many colors and believe it or not, there are countless varieties of cactus available for planting. One is not limited to just the types seen on television, which typically are the saguaro or the prickly pair. Make sure your plants bloom in succession rather than all at once. Check whether you are planting annuals, semi annuals or perennials.
If you like wildlife, there are distinct types of plants that the quail, cactus wren and hummingbird, for instance, are drawn to. This can add some nice variety to your yard as well.
Desert gardeners also benefit in having longer growing seasons. Many desert gardens can stay active from nine to twelve months of the year. Again, this will depend on the assortment of flowers, grasses, cacti, shrubs, vegetables and trees you decide to plant.
When laying out your desert gardening plan, watch out for what is called microclimates within your yard. You can use microclimates to benefit the plants you use. For instance, north-facing walls provide cool shaded areas. Roofs, sidewalks and streets create areas of high water runoff for collection. A microclimate will include variables such as sunlight, temperature, exposure, humidity and wind.
You can also create your own microclimate. Planting a small groves of trees or shrubs can provide wind control and create “outdoor rooms” for sitting. Form a mini-oasis by grouping moisture-loving plants where they can absorb collected rainwater. Color will influence your microclimate, adding dark rocks or walls retain heat, and white reflects it.
The only downside to xeriscaping is the amount of time it takes for plants to mature and the lack of availability in finding plants. Few nurseries will carry the desert plants because they have discovered that people are trained to look for lush greenery. Few growers offer desert plants because they are often difficult to maintain in pots before being purchased. Because desert plants require so little water, they also grow more slowly. But, if you aren’t in a hurry and if you do your homework, you can create and plant a beautiful desert oasis in your own backyard.
